Advertising Terms and Conditions
1. Parties: Advertiser and/or Agency jointly liable: Anency confirms authority. 101.1 More FM (CFLZ) and105-1 The River (CJED) operated by Byrnes Communications Inc.
2. Payment: Payment via Credit Card, EFT, e-transfer or cheque. If invoiced, +1%, net 30 days. 2% will be charged monthly interest on late payments. New advertisers prepay. Ads within 15 minutes of scheduled time deemed delivered.
3. Cancellation: Regular commercials require four(4) broadcast weeks written notice; sponsorships/features requires eight (8) weeks written. No cancellation in first 4 weeks. Purchaser pays for aired ads and related costs. Non-payment = full contract liquidated damages + legal fees.
4. Content: Materials due 4 business days prior to air date. All ads must meet standards and laws. Station may modify/reject. Purchaser indemnifies station. Late or missing material may be billed.
5. Disruption: No liability for non-broadcast due to events outside control. Make-goods may be provided.
6. Pre-emption: Station may pre-empt for public significance. Time rescheduled or not charged.
7. Liability: Purchaser indemnifies for all claims from their material. Station indemnifies only for station-supplied material. For further clarity the advertiser or agency are fully responsible—financially and legally—for anything that happens because of the commercial or content they supply. Talent fees purchaser’s responsibility unless station negligent.
8. General: Subject to regulations/licensing. No assignment without written consent. Materials at purchaser’s risk. Notices in writing. No objection within 5 business days of receiving our invoice equals acceptance.
9. Face terms prevail meaning the terms written on the actual agreement (the “face” of the order) take priority over any conflicting terms elsewhere (e.g., emails, prior conversations, or even boilerplate sections). Invalid terms severable. If any clause in the agreement is found to be invalid or unenforceable, that clause can be removed without affecting the rest of the agreement. Amendments in writing only.
